Ch7..creditor reporting abilites

I unfortunately went through a ch7 BK in late 97.

Questions?

Can a creditor continue to update the account monthly to a CRA indicating 0 paid to keep it current on the reports?

Most have never responded since the BK. But Wells Fargo continues to keep me on the tape as a 30/60/90 day late..monthly....although discharged...as well as others.

The 30/60/90 day issue comes from the date of first notice of CH7 to discharge....LEGAL???...please send me to links that can help.

I now have several of the previously discharged creditors reporting UNDER history with all three...discharged CH7 bk 1/2003

(a new BK 1/2003...didn't happen...heck I'm 5+ years into this, trying to rebuild) when that is not the case via PUBLIC RECORD.

How do I respond to these folks, other than disputing with the CRAs...who tell you after the second verification....that's between YOU and the CREDITOR (experian, etc)!!!!!!!!!!!!! B frickin' S...

I told them to check public record....what's even on file on your CRA report.... ch7 '98... none since...and YOU ARE ALLOWING TO BE REPORTED FRAUDULENT INFORMATION ......response was...It's between YOU and the creditor....huhhhummmm...try to find someone you have the dispute with to talk to...aka creditor (discharged)..yeah right!

Yes they can continue updating the status as zero balance included in bankruptcy.

I do believe they can continue to report the history on the 30/60/90 - but right off the bat, I am not totally sure. The creditors vary on this one quite a bit.

When did your bankruptcy get discharged 1/2003? Sounds like they are reporting double, can dispute this with the CRA to delete the double reporting.

Ask the CRA to provide you with the address of the source that keeps verifing the information. And no they don't directly check the court house, someone else does this for the CRA.</blockquote>
