Chan915
I received a response from Equifax regarding a dispute for my car note (it was paid off 12/14/02). Well they removed one credit card off my report but they added a debt (Dell Computer) that was opened in 4/2000. Where should I go from here? A collection agency was harrassing me about the computer and I was in the process of working on a valadation letter for it.
IronMan
Don't tolerate that crap. This negative hits your FICO score. (I call it the FUCO score)Actually you would want to send a similar sounding letter like this one to Equifux:Dear Sir or Madam:After your recent re-investigations into my disputed items you have failed to provide me with documents that provide support for reporting of the following item which you have inserted into my credit file:Dell Computer 4/2000 $1020.00 COLLECTIONAcct#39293-239029 On its face, this item has the appearance of a re-insertion, mistake or inadvertance. Therefore, you will have 10 days to remove this item or I will initiate civil action under the FCRA section XXX(x), and YOUR STATE LAW section(s) XXX.XX(x) in the ????? District of the Superior Court of Some County in the state of SomeWhere. This debt is detrimental to my overall creditworthiness and lowers my credit score.I will not tolerate any indifference or failure to provide required evidence supporting this reported item. For quicker and reliable response, I will accept faxed documents. Please fax a proper response to this letter with the documentation in your possession to (000)000-0000. Postal mail address is 1234 Somestreet Somecity CA 90000.This will be my only request. It will be assumed that no response will mean a desire to pursue litigation. Any court or attorney fees incurred upon filing due your non-response will be sought through the court irregardless of your response after such filing. You, and the subscriber reporting this inaccurate, unsupported item have not fufilled your duties to perform properly within the guidelines of the FCRA.Thank you for your dutiful cooperation in this matter.Sincerely,John Q. Consumer----------------ENDNow, you can send DV letter to whomever is reporting this. If they don't respond PROPERLY you can then threaten FDCPA, FCRA violations for not notifying you that they will be posting negative info or trying to collect on it and for actually reporting negative info.My sense is that EF will delete it, but will get reinserted again by CA later. Only this time, CA is going to have to work to get it back on and EF MUST send you notice that it has been reinserted and send you verification information. Then you go after the CA. You can always send a C&D letter to CA to stop contact except that which is necessary to respond to your requests. How they handle the DV will give you a benchmark on what type of CA you're dealing with.Good Luck! demoncasterouter
But beware, if ya sue EQ, they'll shut ya out!they deleted 9 positive tradelines off my cr. I was thinking of suing. But then after this, many negs dropped off, and a couple of the positives showed back up. So I decided it wasn't worth getting shut out over. But I do know someone who sued EQ 6 years ago. He is still locked out, and so are all creditors!this would be great if all you have w/ them is negs!
IronMan
Hey, I wouldn't mind that a bit. Having to deal with only one CRA (Experian) will be fine with me. Lock out TU and EF I SAY!I've always wondered about a way to request closure and/or deletion of my entire credit file from Equifax. They are 3rd rate anyway. Cheers![Edit by IronMan on Sunday, February 23, 2003 @ 02:45 AM]
kimber6337
Nice idea, but shutting them out still doesn't mean that you won't have to DEAL with them in what they report and your potential creditors they report to and who reports to them..just going to be MUCH harder to fix it.I'd really like to get rid of them all and go back to the I'll fix your fence if you fix my sick horse days  LOL..yeah yeah I know...hehe

They lock out EVERYONE, including creditors, and. When a creditor pulls her EQ, absolutely nothing shows up. It says no file available....... kb9tbq
Yes, you are right - it will not show up on the creditor side either. The system will prompt them to do a social search, to see if there are additional addresses on the individual to re-run credit report. Other times it will just say no file on record, usually just figure that the individual has no established credit when that happens.
