hollypc Posted March 5, 2003 Report Share Posted March 5, 2003 I sent dispute letters to the CRAs re: a repo. Equifax verfied. The other two have not. The letters were receive on 1/31/03. EXPERIAN - Also disputed some stuff online. Couldn't access my results online, so I called. I told them the repo company and she goes I don't see that it has ever been disputed. I can do it right now for you. I said no thanks I must have the wrong item. Now I did this because if they don't verify it within 30 days they must delete right. Would my next step be sending them another letter, along with a copy of my original letter and a copy of the green card telling them they must delete in 15 days. Please tell me if this is right.TU - I am going to wait a few more days, but if nothing comes should I sent them the same letter, copy of first letter and tell them to delete asap.BTW - All disputed accounts besides this repo have been deleted. This follow up letter is a demand to delete the three referenced accounts found on my recent credit report. I had disputed these 3 items as not mine as referenced in the attached correspondence sent February 6th, 2003. I have noticed that you have noted that these accounts as “REINVESTIGATION IN PROGRESS”. These accounts have not been verified, as I suspected. It has been more than 30 days. I sent the original correspondence Registered Mail Return Receipt. I will attach a copy of it. I demand that they be deleted within 15 days per the FCRA section:§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i](a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer. ( Extension of period to reinvestigate. Except as provided in subparagraph ©, the 30-day period described in subparagraph (A) may be extended for not more than 15 additional days if the consumer reporting agency receives information from the consumer during that 30-day period that is relevant to the reinvestigation. © Limitations on extension of period to reinvestigate. Subparagraph ( shall not apply to any reinvestigation in which, during the 30-day period described in subparagraph (A), the information that is the subject of the reinvestigation is found to be inaccurate or incomplete or the consumer reporting agency determines that the information cannot be verified.The three accounts to be deleted are: Account 56696 Reliance Recoveries Account 73745 Reliance Recoveries Account 684519 Reliance RecoveriesAlso it has been 30 days for the investigation regarding the payment history for the two accounts: Capital One: 65137062 This account is listed as being 30 days late 3 times and 60 days late 3 times. I have never been late on this account.TCF National Bank: 990636204358 This account is listed as being 30 days late 12 times and 60 days late 1 time. I have never been late on this account.Under the FDCPA it states I have the right to ask you to investigate and verify the validity of the reported derogatory information that you placed on my credit report. Also under the FDCPA it states that any inaccurate information should not appear. timbercreektech Posted March 13, 2003 Report Share Posted March 13, 2003 Holly, Got some results from Equifax using the FAXed letter fairly quickly, (less than 5 days).
