Anonymous Posted April 17, 2003 Report Share Posted April 17, 2003 My husband has a credit card, Thankfully my name isnt on it. I am sick and tired of Discover Card harrassment, they call us 24/7. I swear 5-10 times a day and even on sat and sunday, late at night, its never ending!!! I am sick of it!!!! My husband was late in making a payment, he paid it. Sent another payment a few days ago and the payment he sent isnt due for 10 days and they are still calling. Can I get these people to stop calling?? I have talked to him about consolidation, Can you consolidate a debt of $2,000? I cant wait till this debt is paid off so we dont have to deal with these morans anymore!! They kept calling at night to ask for her. Finally, I asked who they were, then asked for a supervisor and told them I'd be in court tomorrow to get an injunction if they didn't stop calling. They sued me for a fraudulent account and my lawyer forced them to cough up papers so I could prove my innocence. Now the matter is in the state government’s hands and he people representing (CA) Discover are trying to do a tap dance. No so say my lawyer – they will do their tapping before the circuit judge. LadynRed Posted April 18, 2003 Report Share Posted April 18, 2003 Yes.. I'd like to know about that injunction too ! There is an elderly and very ill woman who is being harrassed by creditors. She is single, lives with her ex husband as she has absolutely nothing, no assets at all. This woman has a terminal illness and the constant harrassment by the creditors is only worsening her health. I told the grandson to get a statement of this from her doctors, and to send a cease and desist letter, but you know how OC's are when it comes to those ! If an injunction was possible, then it would be worth the expense to have it done. The poor woman is dying for God's sake and they keep harrassing her ! This is happening in GA, btw. calawyer Posted April 18, 2003 Report Share Posted April 18, 2003 I'm lucky because California has its own version of the FDCPA that applies to OC's. But I would think it would be possible to get an injunction even if this were not the case. All states have laws relating to harrassment because spouses seem to love to do this to each other when they split up. It really is no different when it's a third party. When asking for an injuction, the court is required, among other things, to balance the hardships. What possible harm can the OC point to if a Judge says to stop calling?
