I am so angry this AM. Ok listen to this. I called Equifax this morning to speak with them about the disputes on my file since April. This is what "Colleen" told me: "CA's have a mininum of 6 months to verify the information if they have a dispute resolution pending. In your case, you disputed the item, and they replied to us by mail indicating that they were investigating the information." Then she went on to say, after I told her that they were in violation of the FCRA, that I "should contact the FTC and that they could tell me more about how long CA's have to verify debts to the CRA's." I told her that I had sent debt validation letters to each CA and that they had not responded. Colleen again told me that each CA, depending on the CA's internal policies, had a minimum of 6 months to reply once they had reported the dispute to the CRA as "pending resolution"." It seems to me that rules keep changing. :confused: Then Colleen went on to say that we received your other disputes on August 21st and 28th, and those are presently under investigation, each has been notified and we are awaiting responses. The she repeated herself again for the 5th time, "you need to contact the FTC, they will tell you more about your rights under the FCRA." :mad: :mad:

Now what to do?

:mad: :mad: Now get this, I spoke with "Wendy" at the FTC about how long a CA has to answer my validation request, here what she said, "there is not a federal law that covers this, however it is usually 30 days, but that's not law. Check with your state laws that may answer your questions." I then asked her, "so, the CA's could take up to 5 years to answer my validation letters?" She said, "I'm not a lawyer, check you state laws and contact your attorney, have a nice day." Why is everywhere I go, I get a moron on the phone.? Help please

CRAs have 30 days to investigate the listings and if they can't verify, then they have to take it off. However, if they get other information from a creditor, let's say the CA, they can reinsert the listing IF THEY NOTIFY YOU IN WRITING.

The CA's don't have a time limit specified by law to get back to you when you request validation. HOWEVER, they are not allowed to continue collection activities until they validation the debt, INCLUDING reporting the debt to the CRAs.

It's a sad day. Just goes to show consumer's have very few rights. Equifax told me again, that as long as the CA writes to them and states "we are investigating", these items can stay on indefinitely, for up to 7 years. It seems has though they've done this, and yes, dear old equifax sent me a letter back in April stating this. And yes, my CR still shows that it's under dispute-resolution pending. I was told by equifax, that I can submit a statement and any documentatin that I can. I haven't given up yet. Contacted the BBB, State Atty General's Office, FTC, and the Dept of Banking and Finance. Keep your fingers crossed for me.

does anybody know if Trans Union has to show that my accounts are in dispute?They say that they don't, so if someone pulls my credit report, nowhere on there does it say, under investigation. I could have sworn that they have to show some by-line about it being disputed so the potential creditor sees that.

They are nasty, nasty, nasty people. You'd think they would have bigger fish to fry. It's funny though, after speaking with the Fl Dept of Banking and Finance yesterday, their reply to me about the FTC was "well, the FTC is supposed to "take" the complaints about the CRA's, but evidently that's all they do." That remark gave me warm fuzzies :notsure: So, still waiting for the CA's to respond back, again. If you can find anything else let me know, sure would appreciate it. I bought the book and am waiting for that. Hopefully, it'll give me some more insight as to how to fight these devils.

Have one question: I subscribed to the Equifax credit Watch. How often can you get new reports? For example, I ordered this on the 4th, and the report today is still showing the forth. I thought I'd get a new one each day that I pulled it. Does this credit watch work. It's showing no changes. I know it's only been a couple of days, but with all the stuff I've been doing and the CA's and CRA's have been doing, I figure there might have been some kind of updates. Any clue? Tj

I got confused with that too -- when you log in and you see the line showing the link for the report you have already seen, look to the right and up a little and you will see a link that says "get a new one." Click on that, and it will show up as a link to a new report. If you check every day, pretty soon you will have a whole list of reports. What is pretty cool about this is that you can go back and check old reports if you need to.
