Lizzy
On my husbands report he has a public record that we had to pay before FHA gave us a loan. I have been lucky having it removed from TU but EQ will not budge. It reads: PLAINTIFF VERIFIED JUDGEMENT PAID/SATISFACTION NOT RECORDED WITH COURTCan someone tell me what that means? Thanks....Liz
md
It sounds like they verified it with the plantiff and the plaintiff said that it was paid. However, the fact that it was paid has not been reported/recorded with the court as of yet.
kb9tbq
The plaintiff somehow updated the CRA the fact of the matter even though they had not filed proper papers to the court house. YOU don't want to let this go, the court house must be updated on the fact of the matter. It is nice that they somehow managed to update the CRA; but usually in these cases the CRAs won't accept this without the court house showing the fact of the matter. So this is a first time, I have seen them deviate from their rules on this matter. This was paid in full back in 1998. I still have the letter from the lawyer that filed this. Liz
kb9tbq
Call the Court House 1st and ask them to look up the docket number on the small claims judgement and verify with you over the phone if it is showing released on file. If so then you are fine - nothing further to do.But if they have not done so, it is up to you to contact the plaintiff and let them know you want the court house to be updated with the release. If the plaintiff won't then the only recourse is to sue them in court for the changes to be made. (I have seen some pretty mean cases where one wanted to make the other suffer longer - but in my experiences these are the personal cases; not the ones involving businesses).Once the court house is updated then you want to obtain a copy for your records and forward a copy of this to the CRAs.What the problem is here, is that there are a lot of companies selling public record information, not just the CRAs, so it would be your luck that down the line a creditor would see it somewhere else and not showing updated like the CRAs had. Just better to cover your bases on these.[Edit by kb9tbq on [TIME]1057009368[/TIME]]
