Difference between state SOL and CRA 7 year

Recommended Posts

:? Can anyone tell me which takes precedence, the state SOL or the CRA (Equifax, etc...) 7 year on record?

As well, there are some entries on my CR that do not have entries, like date open, date closed, amounts, etc...I find that suspicious. Is this legal? and if not, why hasn't the CRA caught it?

One other thing, I was a sudden single mom a few years ago and couldn't pay a creditor. This creditor took me to court and I have a judgement against me. I didn't know about this until I ordered a copy of my report. On it, it showed the judgement. I never received anything (summons) in the mail or otherwise about taking me to court. I had moved once since then, but always left a forwarding address and phone number. Is there anyway to take this off my credit report?

The state SOL and reporting period coexist. A creditor can only sue on a debt that is within the SOL but the debt can be reported on your credit report for7 years.

As far as the judgment is concerned, you may be able to ask the court to vacate it. You don't say what state you are from but if you look up your state's laws relating to default judgments, therer s usually a procedure for vacating a judgment for lack of proper service. One word of caution, however. If the judgment is vacated, this just "reopens" the case, giving you an opportunity to argue the merits.

Good luck.

Well it depends on what is missing & what does it look like to other key info in the same tradeline.

The ones missing the open date, who is holding the account OC or CA? If a Collection Agency then it may be replaced with an asign date. If the Original Creditor the open date is not so important as finding the last activity date.

Closed date, this could be the last activity date, just depends again who is reporting the lack of information. Amounts don't know what without seeing the whole picture.

Creditors sometimes mess up on their tapes they send in to report, there are mistakes on a regular basis, getting the format right is not an easy task for creditors. But it is also another thing if you find them to be willfully reporting wrong information for the purpose of extending the reporting. Hard to say with out more information.
