Among my disputes, I asked that certain inquiries that were over 1 year old be deleted off of my report. So far I have only recieved a standard response from TU which stated "All inquiries remain on your credit report for two years." I thought that unless an inquiry was for employment it could only be on your report for 1 year? Below is the portion of the FCRA that deals with this:§ 609. Disclosures to consumers [15 U.S.C. § 1681g] (a) Information on file; sources; report recipients. Every consumer reporting agency shall, upon request, and subject to 610(a)(1) [§ 1681h], clearly and accurately disclose to the consumer: (1) All information in the consumer's file at the time of the request, except that nothing in this paragraph shall be construed to require a consumer reporting agency to disclose to a consumer any information concerning credit scores or any other risk scores or predictors relating to the consumer. (2) The sources of the information; except that the sources of information acquired solely for use in preparing an investigative consumer report and actually used for no other purpose need not be disclosed: Provided, That in the event an action is brought under this title, such sources shall be available to the plaintiff under appropriate discovery procedures in the court in which the action is brought. (3)(A) Identification of each person (including each end-user identified under section 607(e)(1) [§ 1681e]) that procured a consumer report (i) for employment purposes, during the 2-year period preceding the date on which the request is made; or (ii) for any other purpose, during the 1-year period preceding the date on which the request is made.It's only a few inquiries that I asked to have deleted so I know it won't have any real effect on my score. BUT if the CRAs are not going to follow the FCRA I'm going to call them on it. Am I not reading this right or are the CRAs just blatantly violating the FCRA and making up their own regulations?Should I wait until I get back the final results of my disputes before I reply? You are reading it right, inquiries that are not employment related should not be on your files after one year. Do you think I should wait to send in my response until I have all of my results back from TU? I don't want to give them any excuse to go beyond their 30 days!!! When I do, I'll be sure to post if they were deleted or not. But I'm betting I'll have to get nasty with TU for them to delete the inquiries.
