Swede Posted August 13, 2003 Report Share Posted August 13, 2003 I am curious about how many times you can dispute the same TL w/each of the "Big 3"?There really is no set amount of times you can dispute, however, the CRA has the authority to label your dispute as "frivolous" and to avoid that, you should dispute different items within the TL such as not mine, balance, open date etc....I thought you could only dispute ONCE, then you needed to add additional info. I noticed w/Experian it says "previously investigated", etc.EX doesn't let you dispute the same item online but I believe you can dispute something else than what you previously have. They won't do it for me period anymore but some people are able to dispute over and over online. If you start out with "wrong balance", you can't really go back and state "not mine" because if it wasn't yours, you wouldn't know that the balance was incorrect.Any advice on how to avoid being "black listed" and the "frivilous" label?Somebody posted this paragraph a while back (I would give credit but I can't remember who posted it) to add to your dispute letter. Basically by disputing different items within the TL such as balance, open date etc, you are in essence providing new information to the CRA and therefore they would be required to conduct another investigation. "You are required by the Fair Credit Reporting Act (FCRA) to re-investigate my consumer dispute even though you have already verified this credit item. Enclosed is additional information unavailable to you when this dispute was previously investigated; therefore you are obligated by federal law to investigate this consumer dispute. Failure to fully re-investigate this consumer dispute is a violation of the Fair Credit Reporting Act (FCRA) and I am keeping careful records of any blatant disregard to adhere to federal law and all such willful negligence" Link to comment Share on other sites More sharing options...
admin Posted August 13, 2003 Report Share Posted August 13, 2003 The other thing you can hit them with is demanding how they verified the listing, which is your right under the FCRA. Once it comes back "verified", you can also send a letter to the OC, there is a good chance they don't have the info, especially after it's been awhile. Many times the original creditor can't verify the information, yet the CRAs say this account is verified. If you relate this info to the CRAs, and even give a phone number of someone you talk to at the OC, you could get them off this way.
