Siren Posted August 14, 2003 Report Share Posted August 14, 2003 1-You request a DV, receive the green card back...2-dispute the tradeline with the CRA immediately following the receipt of card... 3-the CA verfies the disputed TL with the agency but fails to provide you with validation...Is that a violation according to the FDCPA? Must they contact YOU FIRST to prove the validity of the debt before verfiying it as "yours" with the CRA? For example, if you gave a CA 30 days to validate a debt but they verified with the CRA within that 30 day period (and the 30 days are not up to validate with you) does that apply as a violation?Thanks for any input. sisflomi Posted August 14, 2003 Report Share Posted August 14, 2003 The violation would be the ca not forwarding that the account is in dispute under the fdcpa to the cra. When the cra contacts the creditor or ca saying it is disputed, the ca or credtor must report that it is disputed when they have a dispute from you. The validation letter would be your dispute. Thank you for the quick response. I feel so empowered by this site and all I've learned that I want to DRAG someone into court over violation of my rights. I am finally understanding how I've been getting shafted and yanked around by CA's that abuse laws.I spoke to a rep today that confirmed it was verfied as being mine, no mention or anything from the CA that it is in dispute.I think that I need to wait and get the actual letter from the CRA saying the account is verified (which will be dated) then proceed. You know, at the end of May I could not have told you what that acronym stood for and here I am combing them for violations and believing that I actually have a case here. Wow.
