BK reporting question, HELP!

I know that I have talked about this in the past. Could you Please clarify this for me. I could really use some help with this.

On my CR some accounts say:

Status: Included in bankruptcy/Past due 90 days.

or

Status: Included in bankruptcy/Account charged off.

If it is just 'included in BK', please confirm what this means. Does the notation reflect an 'unrated' account. And does it have any bearing on my credit score? Besides the fact that someone who pulls my CR would see it.

Now, it says past 90 days or Account charged off. Do these notations put it back into the credit scoring? Obviously negatively.

What is the best course of action for these TL's? I have yet to admitt to the BK in my disputes.

Should I break down and admit to the BK and tell them to remove the 90 days late and the account charged off? And just report it as 'included in BK?'

OR can I just send a dispute to the CRA's not admitting to the BK, but telling them that ' even if the BK was mine, they should not be reporting the account status TL's other than included in BK?'

Depends on if the past due 90 days is true or not. None of ours were late when we filed. The dilemma however is how to dispute it away without revealing BK docs. Have you tried "not mine". Irecently got HALF of our IIB accounts off off EQ simply by "not mine" even though I committed the mortal sin of sending BK docs to all three CRAs back in 2/03 !

This is one where, theoretically, you could use the argument that showing C.O. is a violation of the permanent statutory injunction against collection activity/process granted with discharge per Sect. 524 of the BK Code. But, again, you're potentially talking verifying BK for the OC/CRAs.

It varies by CRA. I know firsthand that "unrated or bankruptcy" will pull it out of the FICO algorithm on TU.

As I said above, I did get half removed at EQ with "not mine". I have now started on TU and EX TL's which are "loners" (not shown on other CRAs).

Just about everyone will give you the conventional and adamant NO here. However, this is an individual decision which you have to make after getting thoroughly educated and considering your specific credit needs and the timing required. I did the "NO-NO" but, now that we got our hosue refinanced and got a car at 4.5%, I'm ready to start scrapping and have had success already (DESPITE the possibilities admin, KB, and others have mentioned about whether or not CRAs will have kept my BK docs. on file !)

Well, their response, I'm fairly certain, would be to ask you for your BK docs and I would look for other words than to say ANYTHING about BK in writing. Otherwise, you might as well send the docs. I think there are other techniques that can be used before you get to that point.

This is where I am on this stuff and am all "eyes" to see what suggestions people have for you (us).

Also, don't forget admin's suggestion about disputing with DOLAN to posssibly remove BK PR ! I'm chewing on the possibility of doing that myself.

In my state, I gained access to all BK records, for everyone! It is called pacer system and I e-mailed them and they sent me a password to view all documents. Well I found mine. And it is exactly correct! Nothing really to dispute. I already disputed as ' not mine.' Logging on to their system was scarry! I just wanted to delete my BK from their site!

I also logged into PACER, did it show you any amounts? Mine did not, and I'm sure I'll try to dispute those when the time comes. Also, I'm considering writing to PACER with concerns over the SSN #'s being in plain view for anyone with access, and ask for its removal. C'mon guys, you can't give up so quickly!!! I also have some hope, as the Federal court where I filed has moved to a brand new building, from the addresses the CRA's show.

I did this same thing and pulled my report by doing a search with my SS# and my file did not come up. I then did a search with my last name and found it my report. The crazy thing is my legal name is under the alias not as the main name on the header of my documents, the name they are reporting is my initials for my 1st name and completely misspelled last name. I think because of this my CH13 has not shown up in my public record section but my trade lines show a ch13. I guess I got lucky in a way hopefully it will come off easier when I get around to disputing this info.
