This has been going on since 1997. It was then that I started getting calls from a major card office, saying that I owed such and such amount on a debt. After a little investigation on my part, I found out that a relative had made the purchases (I didn't own this card!). I asked the credit card company for a copy of the original application sheet and a list of the transactions, but all I could get was "sorry sir, we can't do that". I called this so-called relative and was told that he would take care of it. Okay, I'm stupid and naive.

Anyway this pattern continued over the next few years, me getting calls from first the credit card company then later from subsequent collection agencies (charming people, all). A couple of times I believed their bullshit and panicked, making a couple of payments (I thought they could garnish my wages, but now I know they can't, this being North Carolina. I also own no property). Its now five years later, and I finally went to a lawyer, asking what I should do about this. He helped me make up a verification of debt letter which I did, I sent it certified mail and waited 45 days. I got a call from an agent :roll: demanding payment of the debt. When I informed him of my letter he gave the phone to his supervisor who told me that he did NOT have to send me verification because of the couple of times I made a payment, that that was admission of the debt on my part. Is this kosher? Is he right? And isn't the debt past the statute of limitations? Advice?

Send a complete C&D. If they take you to court then you have your defense. They failed to validate the debt and the debt was not yours to begin with.

You didn't co-sign for anything did you? Just checking. Some others here will have more advice with respect to your other questions.

I was told that I was the primary card holder! I don't remember EVER signing anything. I have asked this relative a dozen times, "did I sign anything??" He says "no." I even have a signed afadavit from him stating so.
