Need opinions....

I contacted an OC via certified letter to see if they had knowledge of an assigned account that a CA is attempting to collect on and also to see if they ever received any payment for it. An employee immediately called after receiving the letter and told me that they haven't used that CA in several years (the account is over 6 yrs old) and that she would call them and look through their own collection records then call me back. She stated that I would probably not hear from them that day though. Now it's been a week and I haven't heard anything from the OC. I'm not sure if I should call them back or not. I've been stressed all week because I know that there are a few ways this can play out, not knowing is the worst. Should I call the OC back? I have a feeling that they aren't going to be calling me back for some reason. If anyone can give me their opinion I would greatly appreciate it!

I would call them back, and follow up on this matter, if they say they have not used this collection agency in that long a period of time, then if it is still on your credit report get something from the OC in writing so you can forward to the CRAs to have removed off of your credit report.

If you still have an outstanding debt, that is still beside the point, they should still rectify the matter with this CA being able to continue reporting on an account which don't belong to them any longer.

I'm getting the run around! I called the OC and the woman I talked to last week "was on the other line"... Uh huh. I was told by the secretary that she usually calls people back when she finds out info and she knows that she was working on the case because my letter was on her desk. So, I called the CA and had to leave a message. I asked why it was still being reported when the OC has been sold to another company, the new owners have no knowledge of this account and they no longer use this CA. I don't know if that was a bad idea or not. Shoot..I hope I didn't mess up.

::EDIT:: omg! The CA just called back and hung up on me! I asked why they are reporting this and he said b/c I owe money. Then he asked how I'm going to handle it and I said I'm not, I don't owe you money etc. and he hung up! Now what?

File a complaint with the FTC / BBB / Attorney General against the collection company for reporting on debt which does not belong to them.

Also when you make contact with the Original Creditor again, let them know of the harrasement which you where treated to by this collection company. And ask that since they told you they no longer used this collection company you would appricate them retracting this collection and put them on notice that this is not their debt any longer to be collecting on little lone reporting on. Also see if you can get this in writing from the OC for your records should you need this later on as proof. If you get this letter you can also forward a copy to the collection agency yourself & the CRAs to get removed.

The only way they could continue to collect on this, was if they had purchased the debt from the OC, but from what you said, it sounded like the OC had just assigned the debt to them. So it should be fixable.

Thank you so much for your help! I will file the complaints against the CA today. I'll also call the OC again today to let them know about the CA's behavior, if I can't talk person who is handling this I'll just have to send them another letter. Thanks again kb!!

By your initial contact, sounds like their treatment should be decient and hopefully you can get what you want here in this matter.

In some cases day to day here, I find some employees to be quite decient and not all about messing with you as you would think, some of them just go through the process and will let you off the hook, if they know they can't find you in the system and they can forward letters to the fact to clear up matters.

You might even ask the this employees name and their fax number to send you follow up letter to her, that way she will know you are 100% interested and invested in resolving this problem.

I do have a question though. I am in the process of writing my complaint. Should I give an accounting of all the events or just leave it short and sweet, stating only that they are no longer authorized to report/collect on this account? The complaint I wrote has details about their partial validation, inaccurate reporting on my credit file and what the OC told me on the phone last week, etc. Is this overkill? It's over a page long.....

Would put it something like this.

Dear Creditor,

I initially contacted your company to research a matter that until recently I was unaware of, as of yet I have not heard back and would greatly like to resolve this matter quickly if at all possible, the collection agency .... I found on my credit report. But our last conversation you informed me that this was a company no longer working for you.

If you may please help me out in this matter, the collection agency has been abusive and will not acknowledge that the fact that they no longer hold this account. Can you please intercede on my behalf to notify them of this fact. If you can please confirm this in writing for my records I would greatly appreciate this.

Thanks for your time and attention in this matter,

**** I am by no means a correspondent on these matters, but this I think conveys sincerity and politeness to invoke their attention on this matter, hopefully.
