Medclr = NCO = lawsuit

:eek: Long story here, but this is what I found...

Baylor Hosp is OC. Allegedly, sold accounts to "Medclr". Time passes. Medclr is on DH bureau. I dispute for him. Suddenly 90 late is reported on 1 account. Disputed again with CA (NCO kinda sorta). NEXT DAY they reported new 90 late on both accounts. Score plummets to 400s!

Call EQ. Eventually 3 way call with me EQ and NCO. Even though docs to EQ from NCO stated that NCO bought Medclr accts, NCO rep says NO. "NCO only reports FOR Medclr who is an authorized installment creditor with EQ and that is how we are reporting it!" Explain recent 90 day lates w/o activity for last 4 YEARS!!! yadda yadda and it goes on. NCO claims that THEY did not report 90 day lates on 7/2/02, EQ did. Ticked off EQ VP that was on 3 way call! EQ took off 90 day notations but did not delete.

Here is the fun part!!!! :D I contacted the state of PA (where the address I was given to serve Medclr w/lawsuit which btw was identical to the address I was given for NCO!) Medclr is not registered to do business in PA. NCO does not have dba of Medclr nor is there any record with the State of PA that Medclr was bought by NCO. :rolleyes: This gets better!

Medclr is not registered in TX where the hosp is. Medclr is not registered in SC. You absolutely, positively CANNOT get a name, phone number, nor address that is Medclr. All Medclr leads to NCO!

VP of Consumer Relations at EQ is sending info to compliance department.

NCO is guilty of mail fraud and wire fraud for collecting on a ficticious company name. They are listing Medclr as OC. They won't validate. They are claiming PA SOL as their authorization to continue collections on accts that have passed the SOL in the state originated and/or the state where consumer resides. :eek:

Aside from the standard FDCPA and FCRA violations, this is unbelievable.

In my email to VP @ EQ, I demanded that Since there is NO proof that Medclr is an actual OC for ANYONE, that they are obligated to delete ALL Medclr references on ALL consumers in their database!

:D :D Having fun. Filing lawsuit friday. Turned info over to BBB of PA, BBB of TX, BBB of SC, AG of PA, TX and SC, and the FTC!!!!

It is my hope that we can finally put NCO out of business!!!! :p

Whoa! Good job SCMom! :eek: Veerrry interesting.

I have been working on my debt validation letters tonight. I combined all 3 CR's and I only had one duplicate listing out of the 6 total negative's.

The duplicate waaasss~

two collections for $252 (medical), first Medclr and second NCO Fin. Sys. Different account numbers.

So, I'm wondering; with all it seems you and Jordanmorgan have gone through with Medclr/NCO should I even bother sending the DV letters to them now? Check first to see if they are licensed in Arizona? If they aren't, where should I go from there?

Any ideas would be so helpful ;)

Anyhoo, wondering how things are coming along in the last couple of weeks since you first posted??

Still waiting to hear back from the compliance investigation that was launch at Equifax as a result of my findings.

My DH is the one who has to file the lawsuit since it is on his CR. The problem is, his brother died last week (38 yrs old - in his sleep) and he is in california for the services.

He will file next week. The have racked up a huge number for FDCPA and FCRA violations!

Follow up on Equlifax. Today I checked DHs CR and the Medclr accounts were deleted.

I had challenged them as (1) Not licensed to do business in PA (the address listed with the credit bureau) and (2) NCO = Medclr and they are not legally able to use any company name except their own.

Next step is to follow through with the lawsuit.

Thanks a bunch for the update SCMom :)

I just sent Medclr a DV letter last week but I think I'll go ahead and dispute it now with the CB's.

Called around on Thursday to try and find out if Medclr was licensed in Arizona, and got the runaround; but no one I talked to in either Pennsylvania OR AZ had any info on them~go figure.

I had been surfing some different sites and from what I found a CA does not have to have license in PA (I am also in PA). Do you just mean a general license to do business in the state? To what license do you refer?

SCMom! Email me. They actually sent me some BS from Marlin Integrated this week! I am suing the living HELL out of them. All of them. NCO, MedClr, Marlin Integrated, whoever they are this week. And I'm getting my awyer to do it. Can you say KA-CHING!?!?!? And CBCS and Superior Asset Management. For like $20,000 each. And I've decided to go to law school. Lying b*stards...

Alf,

In speaking with the Corporations Office of the Secretary of State for the State of Pennsylvania, you MUST have a license to do business in PA. Understand, Medclr et al are based in FL. They USE NCO's address as their base for all collection activity. That implies that they are doing business IN the state. Big no-no.

Not to mention that it is illegal for NCO to use any Marlin name in collecting. :upsidown:

That's just part of the suit. Once the FTC gets a hold of them, WHOA NELLY! It's a bargaining tool. I've said it before, and I'll say it again. When we all start writing letters to the BBB, FTC and AGs, these boneheads will know they can't fool around. It's not until they start paying out hundreds of thousands and have the government breathing down their necks that they will conduct business properly. It's all about money, and when they lose it because they are being underhanded, they will have no choice but to behave or get out of the game.

OT, but has anyone seen the movie "Fresh"? It's about a little kid that takes down all of the drug lords in his neighborhood by playing them like his father taught him to play chess. No one thought that he was a threat because he was so young. Tape EVERY phone call, fax or send everything CMRRR. Get names, ranks and serial numbers. Never underestimate them. And don't let them scare you. Those mf-ers wait for their paycheck just like everyone else. Surf this site, the ftc site and the web. Print out and study the FDCPA, FCRA and your state's civil codes. Get a calendar or day planner and keep track of EVERYTHING. Do NOT be scared.

Thanks for reminding everyone to report violations to the FTC. I've been on that soapbox for years and I don't seem to be making headway. When this year's report to Congress came out, it was pitiful how few violations were reported. We will never get stronger laws if the Feds don't feel there is a need.

I hope you were serious about going to law school. It is tough but I know you would do well and become a great lawyer!

Calalawyer has has the right idea. So, why don't all of us on this board and anyone we know that has dealt with A$$et call FTC during this next week and overload them with complaints. The only thing to remember is that all complaints must be legitimate and verifiable. In fact, I am doing it tomorrow and will definitely include how the State Offices could care less about how A$$et does business. The lady I talked to made that quite clear. Also, have everybody log on to EdCombs.com and submit their info. I did and received a response back the next day. In short, I have sent them the documentation I had. Next

on the list would be the other "ADUB's" out there.

these buttheads are on all 3 of my reports.

medclr is on my equifax 3 times and marlin integrated capital is on there once

on my tu medclr is on 3 times and nco is on twice and powell inc is also on 2 times. i believe powell inc is another name for medclr and nco.

i have disputed all these entries as i have never been to the hospital or doctor and they have been listed as medical collections. lets band together and bring medclr and nco financial systems down
