Guest Posted February 20, 2003 Report Share Posted February 20, 2003 Has anyone heard of a CA "Asset Resources, Inc." or "S&P Capital Inc." in Pensacola, FL? I can not find them in my licensed CA list or any debt collector list or BBB listing. Anyway, someone from there called my wife about a very old account with Circuit City that claims is in debt. This has to be bogus or someone has used her info to get a CC. In other words, if they can steal my identity they can steal hers too!When will it end!!!!! The account was opened in late 1993 and they say it had over $1.5K on it! Weird to say the least. Guess the 4-year SOL for FL is like ended, huh? Let's see 2003 - 1993 =, er, what's this new math? I found out what this was about and it is one of those idiotic deals where my wife purchased a few small items at Circuit City on their credit card. Before she could pay it off the next month they changed the card to a MC with First National Bank of America and transferred the charges over. She paid that off and left zip balance in both, she assumed. She had not heard from them in years when Circuit City collections department bugged her. She disputed it and they called to apologize and closed the thing – she thought! Then some CA called her so off went three DVs and with no reply. They sold the bogus account off to S&P and now they called. I mistakenly answered the phone (with caller ID and privacy on line) but yelled at them with Federal law and all that. It was like fun.So, the guy stated something like they had a warrant for her arrest, then quickly changed tunes when I quoted law, and so on. Then I confused that guy he facts and a so-called para-legal got on. I confused him with the facts as well. They gave me what I think is a bogus address so I told them I would send a DV and the guy warned me, blah, blah, you know the story, and said all deals was off, etc., so I said “please do sue her!” The SOL is up in 5 months according to the so-called last payment that is not on record that I know of. So, it will take at least four months for them to get the tattered documents, and other month for her to reply and SOL is over.Hopefully this will end another fraudulent collections. When we moved their billing got behind and of course they blamed her for their late mailing list update. Anyway, both accounts appear linked to the time and balances, plus it is the same bank. For some reason they changed the account number from the first to a Master card. Why? Who knows. Anyway, since I have problems with ID theft we assumed the same with her. Maybe not, but without documents there is no way to tell. After nearly a year I finally got documents and a forged credit application from Discover Bank. I had my lawyer witness the affidavit of fraudulent credit application for the CA and small claims court judge. He is not happy with them anyway and they have failed to show up for dispositions and other stuff. My lawyer is confident that my case will never get to court, but in case it does it will be taken to task post haste with the obvious lack of spelling and obvious attempt of forging both of our signatures. The billing statements that Discover swore to in their interrogatories has my current address on them from a time a year before we moved to this address! I only hope that my honesty, integrity and my lawyer’s ability to argue the case will prevail. I can’t afford to pay for some thief’s greed. So, after nearly a year of this I have almost lost faith in my country. Heck, I am a right-wing conservative on Social Security who defended my country for eight years. What to I count? Has free enterprise really fallen to the depths that I assume it has? I trust no one anymore. We live and learn but in my case it was too late! If they transferred the amount to the new then how did the screw-up come about? By slim chance, do you have any of the original records? By the way, all vets stick together. We moved twice since then and besides all the junk I pitched out we lost the contents of our kitchen desk drawers! Of course, we had all our bills and receipts, and some old check stubs in the drawers. Well, ain’t that the American way? I am a pack rat who had junk from my teens (50 years ago!). Of course, what we lost would help clarify the mess. I'm not worried because from what I read these CAs usually threaten people and their follow up is lacking. The SOL is about to run its coarse (course) so we'll wait that out. I would hate to think we may cheat someone but if they would have notified us and given reasonable information it would have been taken care of by now. This credit business has gotten pout of hand and I hope some day we get back to honest, efficient business practices. It reminded me of the old shell game, the guy just would not show me that set but wanted me to buy their “selected” TV of the day. That was eight years ago and I have not been back!Yes, the credit card started off as a store card then was replaced by a Master Card – like so many stores do today. "panzies" is an understatement!I just do not have to money or inclination to sue them. If we wait them out chances are they will not take her to court and, if so, by that time the SOL will have wiped that out. This account was paid off and should have never gone into collections. Like the other peole here I didn't hear from Circuit City for years...Anyway, I asked the credit bureau to investigate. The results of the investigation ended with deletion of both companies on my credit report. I recently decided to take advantage of the low interest rates and re-mortgaged my house. At this time I found out that S&P Capital was back on there. I called them to find out what the deal was. I ended up being treated like a second class citizen. And the "Collections Supervisor" actually asked me "Why would circuit city sell me this account if it was paid off?" To which I replied "Well, I'm not quite sure that is why I had this investigated and subsequently deleted". His response was "Well, we make adjustments each month and I'm going to personally gaurantee that this will come back on your credit report."I have been advised to file a complaint with the Federal Trade Commission. I am going to file this complaint (along with the copy of the investigation results), include this supervisors name and the address ASAP. I'm also going to file with the Better Business Bureau and I am lastly I am going to write a letter to Circuit City to explain to them this this very unprofessional company does not make Circuit City look good. When the morons who populate credit departments of these companies get fired they go to be collection agents. Talking with some of these idiots is real entertainment. However, if these people insist I will take them to court and waste years of their time and money -- they will never recover their bogus debts because they are not mine! It is sad in a country where so many minds ae wasted in such occupations as CA's to be paid for doing nothing. Hang you heads in shame CA idiot.
