mrsmo914 Posted September 24, 2003 Report Share Posted September 24, 2003 K, my eyes are blurry and my head is slightly fuzzy because I have tried to immerse myself in this stuff for a couple of days. I think I have read to much because now I am confused.My boss got a call from a CA on Friday about an advertising account that we knew was late, but had made a payment on September 2 for $100. The CA gave him a higher total on the phone and boss said that was wrong, he would consult records. He told me about it, and I said DO NOT discuss anything with the dude on the phone. So, CA called yesterday, I told him we disputed the total and I choose not to discuss anything with him on the phone. He asked if he could fax me his figures and I said sure.He faxed a copy of last months invoice with a hand written addition of collection fees.Here is my question:We have every intention of paying this bill, I would just prefer to not deal with the CA. Can I just send a C&D? and make another payment to OC so that if he tries the judgement route, it would appear that we are trying in good faith to pay bill? Or should I still send a DV? So the FDCPA won't apply here, I am not sure what to advise.. might try locating Ladynred in the collection section of the board.I would suggest bypassing the collection agency and getting ahold of the creditor directly to settle the matter.Oh, and the pictures are provided by Capepuffin... all you have to do is drop her an e-mail with your request, she is around on a regular basis to fine a post of hers nearby.. also in her signature line is a link to her web site.. that you can see all the pictures so far she has created.If the collection section does not work... might try the legal section see if you can find put this where some of the other members may see that can suggest something on this matter for you. mrsmo914 Posted September 24, 2003 Author Report Share Posted September 24, 2003 The thing is, he is a sole proprietor, so his business debts are on his personal credit record etc.Also, the CA did not put disclaimer on the fax about the information being an attempt to collect a debt yada yada if you dispute yada yada...don't they have to? I am no good at this part... but yes if he is sole owner with personal debt... may just be covered. Swede Posted September 24, 2003 Report Share Posted September 24, 2003 It gets really confusing when the information is scattered throughout the site and you won't get the best possible advice because people won't have all the info. It's better for you if you have all the info in one thread and if you do open up a new one, at least link it to the other one so people have all the pertinent information. Also, most members here browse all the forums so as long as it's in the relevant one, you should get the answers you need, if not, you can always bump your question.
