Proper Filing forms...SIS..Swede ....Anyone

Ok. Afni has a entry on my report in the amount of 264. I have sent a DV..no response. sent an estoppel no repsonse. Fed up with these jerks i have recently sent an ITS letter. I just want the damn( :evil: ) removed. If i am not mistaken i am supposed to file in small claims court but i am not aware of the proper forms. Here is a link maybe you could tell me the correct form to use. www.nccourts.org. I am in north carolina BTW.

Did you dispute with the CRA's? Have you filed complaints with the AG/FTC/BBB/PFB?

Yes Ma'am. Did that several times. This entry was deleted from EQ not EX. I have sent DV's to AFNI ,estoppel etc. the entire plan i have done. I even spoke with their reps and she told me they would send information in the mail and they never did. I even called back and ask a guy htis time could he fax it to me and he stated that they do not fax anything.

FDCPA Section 809 (B),

Collection agencies if they have not validated your debt and they still continue to report to the credit bureaus

IMO that's pretty weak, if it's your only violation. You can send an ITS, with filled-out SC paperwork, but I don't think you'll get far in the courtroom if it gets to that point.

that's the small claims form for NC.

The reason I don't think you'll get very far is that most small claims judges aren't very well versed in the FCRA and FDCPA.

I've seen small claims judges say that 4 months isn't enough time to update a tradeline as being in dispute (the only requirement that a CA has when you ask for validation) and dismiss the case.

But hey, if you want to spend the filing fee and have some judge ask you WTF you're wasting his time for, go for it.

Most people who win suits against CA's and CRA's have more (stronger)violations to add to this one and throw this one in for good measure.

Just my opinion.

And yes, I've been MIA - busy with creditboards and real life ;)

BTW cookie..my secomd violation is FDCPA

Section 807(8) If you dispute a debt, the collection agency fails to report it disputed to the credit bureaus

Still based on the same premise.

I'm not trying to discourage you, really, I just don't want to see you lose.

Bait them! Throw your line out there and get some more violations!

AFNI will help you build your case, really ;) Just give them a chance to do it.
