floridagal Posted October 1, 2003 Report Share Posted October 1, 2003 Hello all!!Dec 2002 had credit card deleted from credit file...it is now back on (with out notice) along with CA trying to collect. Have others where I got the file deleted now have CA trying to collect. My question is once OC is deleted can CA still try to collect? What is the best way to deal with this? Thanks for your time!! nativechild48 Posted October 1, 2003 Report Share Posted October 1, 2003 Did you pay this off or was it charged off and sold before SOl If the file is charged off but not SOL, it means it might have been assigned to a CA for collection, or it might have been sold an the CA has placed it on your file legally or illegally. md Posted October 1, 2003 Report Share Posted October 1, 2003 If you had it deleted as a result of an investigation and it was reinserted without proper notification then you can demand permanent deletion.However, it being on your credit report or not has no legal bearing on whether you still owe the debt, whether they can assign it or sell it to a CA, or whether they can continue collecting on the debt. Yes, you can demand permanent deletion; however, CA can't properly validate the debt then they can still try to collect on it. Have you DVed them yet?
