Suing Capital One

I called Capital one today and they stated that they are going to continue to report to the CRA for Seven years and I will contiune to accrue interest. Now can they do that the account charged off in 1997 and the stautes of limitations in California are 4 years concerning open accounts, do I have a case to sue and win?

Please don't call and talk to them. Conversations have a way of being misconstrued.

They can accrue interest till the cows come home, but if the the case is barred by the SOL, they can't sue to to recover any of it (actually nothing prevents them from suing but they won't win if you don't default). Charge offs cannot remain on your report after 7 years.
