BustedCredit Posted October 10, 2003 Report Share Posted October 10, 2003 I requested DV from several CA regarding CC accounts they were attempting to collect on. None of them have validated yet but it seems that they have been returned to the OC as I have received new statements from the OC well after requesting DV from the CA. There is no way I can settle these now or in the near future. What do I do now? I assume the CA gets out of validating by returning it to the OC. Is this a common practice? kb9tbq Posted October 10, 2003 Report Share Posted October 10, 2003 This is an opportune time for you.. to negotiate with the original creditor before they assign the debt over to a new collection agency. This way you can negotiate for good reporting from the OC as well as get the assigned collection agency's tradeline removed off of your credit report!Yes, this does happen, unfortunately not all the time though. Do you know if you are still within the SOL on this account?All depends on this as to what you should do, if you are still within - my recommendation is to lay low and put off DV and credit repair until you are in a safer position.If you are outside of the SOL, then all you have to do is cease & desist the next collection agency that tries to bother you on this.. even DV letters as you go. It does in some cases become a circle jerk on this part.Remember that you can't cease & desist or DV the original creditor... they can continue collection efforts all they want - just that if you are out of the SOL - they can't sue you. BustedCredit Posted October 14, 2003 Author Report Share Posted October 14, 2003 My last payment was 01/03 so it is still well within the SOL. I recently went back to work part time after 9 months of unemployment. Unless a large sum of money falls from the sky and clunks me on the head there is no way I can even make payments at this time.
