Lisa Posted October 13, 2003 Report Share Posted October 13, 2003 DH and I filed BK in 2001, and it was finalized 01/2002. We included our house in the filing. How should this be reporting on our credit reports? We had a judgement filed against us in 09/2002 to foreclose, although it was included in the BK. This is showing on only one of the credit reports. Should I dispute this, or is this correct?Also, how should all other accounts included in the BK be showing on our credit reports?Thank you for any help you can give! kb9tbq Posted October 13, 2003 Report Share Posted October 13, 2003 It is my belief that the judgment should not have existed especially for them to file after being informed of the bankruptcy..On this one, go back and talk to your bankruptcy lawyer - I bet this one should not even exist.On all other accounts that had been included in the bankruptcy.. technically they should report as:Zero balance included in bankruptcyIf it says any thing else, like collection / charge off with a balance it is reporting wrong. This happens all the time!!!!! But what you should do is start out, disputing them as not yours first to see if you can get it bumped off of the credit report first...If you can't then later dispute for accurate reporting... by including a copy of your bk papers (schedule F) the CRA should get them updated in no time. It was actually filed by a bank that we previously had our mortgage with, and they were paid off when we refinanced with the bank we filed BK against. kb9tbq Posted October 13, 2003 Report Share Posted October 13, 2003 You talk about the forclosure, was it included in the bankruptcy... You say the prior bank filed the forclosure? Something don't sound right here... if they had been paid by the later bank - they should not have even filed forclosure.It is said that if you discharge the bankruptcy - unless you re-open to include that creditor you may be stuck paying them. You need a lawyer on this! To look and see if there is something over looked and to try to remedy it as quickly as possible on this matter. Lisa Posted October 13, 2003 Author Report Share Posted October 13, 2003 The house was included in the BK. It was funded through Homecoming Financial. The previous funding for it, prior to refinancing, was through Bank One. Bank One is the one who filed for the foreclosure. mrsmo914 Posted October 13, 2003 Report Share Posted October 13, 2003 If you have your accounts changed to 'included in bankruptcy' that pretty much makes it a challenge to remove the bk itself as 'not mine' doesn't it?
