bgbg1 Posted October 15, 2003 Report Share Posted October 15, 2003 I'm getting rapped by FNAB. They keep putting lates on my account. I went into cccs and FNAB accepted my payment of 84$ a month. I ended up a month late at that time. Then they said that I had to make 3cons payments to be in the program. I did and they put a 30 60 90 120 lates on my credit report. Then they removed the 90 and 120 this june because I've been making payments. Well this last month of Sept they put a 30 day late. I checked my account it seems the whole time they stated my payment to be 123$ but the letter from them states 84$ a month. They screwed it all up and I'm paying the price. Just checked today and another 30 day late for october. I called and the lady said she would send it in again to be fixed just like last month. I don't know if this will ever get worked out. I really need this crap off my report is there anything I can do? Oh yea the letter also states that my first payment is do within the first 30 days of this letter at the time was Jan 21. So my payment would be Feb 21, March 21 and april 21 instead of my account payment of the 13 on every month. They charged me lates all through that time period. Should I just get a lawyer and threaten to sue can I do that? I feel like not paying anymore money to them send it to collection and then offer half of what I owe and make them remove all lates and collection at that point. kb9tbq Posted November 2, 2003 Report Share Posted November 2, 2003 See this is a tricky problem, that alot of people run into when negotiating and having a cccs program in the middle.Need to understand exactly if your cccs program is sending them the agreed payment at the right time of the month.Being that you have a letter saying that this creditor agreed to that exact amount and they now say that you owe more, I would suggest writing first an ITS letter to them, and including copy of this other form that showed the lesser agreed upon amount.Or when you do call in make sure to have the rep forward you to a superviser there to talk about this repeated problem. There are several ways this can work out... also it might not hurt to get a tape recorder with one of them - nice little connecters that attach to the phone for recording... not all states allow this if you don't inform them that they are being recorded. But you can still get around this by writing your notes down from the tape then saving it that way for later use.Keep track of dates and time, and name of person you spoke to.
