My case against Federal Credit Corp.

Well, it's going to be official soon I believe. Talked to my attorney today and he wants to send FCC an affidavit on his letter head to let them know that we mean business. He also wants to go after them in a class action for the BS that they are blantantly doing, (see my thread in the "Collections" forum, http://debt-consolidation-credit-repair-service.com/phpBB2/viewtopic.php?t=9206)

I sent him copies of my credit reports today, including a BRAND new report from TU with dispute results for FCC saying "verified, no change"

He plans on going after them for all we can, including that on their website there is an ad for Equifax, to which he said "another deep pocket if they are in affiliation."

My husband had them to show up on his credit report - showing Sprint as the OC with a 9/03 date. He called the CA to find out what it was about, and come to find out, it was for a Sprint bill back in 96!! They re-aged the account! We sent DV and disputed after getting the green card back. We haven't heard anything yet. If someone is doing a class action against them, please let me know. It's so discouraging to work so hard and then something like this comes up out of the blue!

FCC called me tonight about my fax to them, over a month ago, that was my proof that I had already paid this debt. The lady went right into telling me who she was and that she was in receipt of my fax but the account numbers didn't match. I had to stop her right there, until that point I hadn't been able to get a word in edge wise. I said "my attorney is handling this matter." To which she quickly replied, "I won't say another word then." and hung up. If only it was always so easy to get rid of a CA. I'll have to let my attorney know about this first thing tomorrow. This was attempted collection activity. I take it they hadn't received the affidavit from me and my attorney yet LOL They should get that any day now, and it's basically an ITS.

It's been quite a long time since this issue has been on the front burner and guess what I got this week? ANOTHER collection attempt from FCC! I called my attorney today and left a message about this new development. He later left me a message that FCC contacted him in December, after they received our affidavit, still asking for money to settle. He said that these people just don't give up and we're going to check my credit report to see if it's still reported, it should've fallen off last month. Lawyer also said that it's time to take this to court. Hooray!

Credit repair took a back seat over holidays and moving into our house, but there are a few issues remaining, like this one and my student loan mistakenly reported, that it's time to get tough on! My case against JBC is being settled as we speak, that's $1000 headed my way and if I can sue a few more places (and believe me, I do have a couple good cases yet to pursue!) I can use the money to finance a couple rounds of fertility treatments...at $1500 a pop, I can use the help :)%

Back to this topic though, I was amazed to get a new collection letter! These people are either incredibly stupid or have big ba!!$, or it could be downright greed! But either way, play time is over...let the battle begin xdazzlex

My brother may be interested in joining a class action lawsuit against these idoits. They are trying to collect on a Sprint account that is not his. He has a very common name and they are trying to collect on an account belonging to someone else. He has never had an account with Sprint. He has told them this but they only want money. This account is also SOL, supposedly from Oct 1997.

So far they have done the following:

1) Initial dunning letter did not include the 30 day right to dispute warning.

2) Sending at least 3 dunning letters after he sent them a certified DV letter.

3) Admitting on the phone that they did not have any original documents from Sprint. They refused to contact Sprint for the original account info, since it would cost them too much money. :shock:

4) Adding account to his credit report after he requested validation.

I have advised him to file complaints with the FTC, Ga State Attorney General, Texas State Attorney General, ACA, BBB, and U.S. Post Master for mail fraud. He is also contacting his attorney. My brother is currently under Chapter 13 Bankruptcy. When he told them this, the girl claimed she called and had this account added to his bankruptcy. I have told him to also record any phone calls. Georgia and Texas are both one party states.

My brother is going after them with both feet. My bother can use an extra $1000. Too bad it is not per violation. :(

I received a copy of what my attorney filed against FCC. I spoke to him yesterday and he said he hadn't served FCC with this yet, he has so many days to do that and in the mean time he's doing more digging into a possible class action lawsuit.

We're alledging 2 counts of violating FDCPA, count one is communicating with me after FCC knew I was represented by an attorney and count 2 is that FCC is vicariously liable for the FDCPA violation of is's agent, employee and/or joint venturer (the guy who signed the letters I got after they knew about my attorney).

My attorney expects a slam dunk with this particular case, but he's still digging into going after Sprint and Gulf State Credit for this whole mess.
