We have been mostly successfully following the debt validation strategy. However, we have one creditor who has sued us in court without validating the debt. We have proof that the creditor - Capitol One - wrote off the debt in March. We also have proof that when their legal guy contacted us in August, we sent him the letter requesting debt validation (which he never picked up from the post office) and he filed a lawsuit against us at the same time without waiting the 30 days and without validating the debt. We are preparing for an evidentiary hearing on Dec 12 ... any ideas on how to proceed to get this case dismissed with prejudice?
