EQ officially throws in the towel :)

Got a call from an EQ attorney towards the end of the afternoon today. Turns out my earlier guess was right: They've finally raised the white flag.

The guy basically said EQ wants nothing more to do with me, and will give me whatever it is I need to make me go away. They deleted a bunch of tradelines earlier, and will delete the rest as soon as they compare the signatures the last 3 CA's are providing to make sure they aren't me(which they aren't). He assured me that they will take care of it ASAP, and for me to please understand a very short delay.

Since we were all being so chummy and friendly with each other, I very kindly reminded him as to the issue of the judgment for 9 grand I just got against them, plus the one I was about to file for their violation of the liquidated damages provision in our previous settlement, which'd be worth another 15,000. He very kindly informed me that EQ would be FedEXing me a check for $24,000, and then not-so-kindly reiterated to me that they never want to hear my name mentioned again once they delete these last 3 tradelines.

Yeaaaaah, that's right, boys. You CRA bastards want no part of this...I'm like a friggin' New York cockroach: stepping on me only makes me angry; swat me away off your couch, and you're only gonna find me in your soup 10 minutes later, and only the Twinkies will outlast me :p.

Woo-hoo - time for the Snoopy happy dance! Just curious, is that payout considered taxable income?

I imagine that if the majority of consumers who had problems disputing inaccurate information were as persistant as you have been in pursuing the matter through legal remedies, it would not be long before the CRAs actually started to pay more attention and realize that they need to get there act together. Alas, although the $24,000 will probably make your Christmas that much better this year, EQ will simply claim the money as a buisness expense, take a tax deduction, and in the end the company will not even bat an eye as the award is less than .001% of 1% of the companies annual revenues! :x

They have some balls telling you they don't want to hear from you again. Did you tell them that as long as EQ stays on the straight and narrow, you'll have no reason too? Watch the TL comeback in 6 months....I hope the new agreement at least doubles the current LD provision!

Nope, no new agreements. I just told them as long as they don't make me come after them again by screwing up, they'll never have to hear my name again, but if they did screw up.... :p

I honestly don't know, but if I know my Uncle Sammy(and I do), I'm sure he's got some sort of method set up to dip into my pocket over it.

That's my whole angle on this thing: I *TRIED* the polite "I'll send dispute letters out and nicely ask them to remove the tradelines" for a while...it was time consuming, it was effective but not THAT effective, it ws frustrating, and there was a 30 day "stress" period during disputes. With these lawsuits it was wham bam thank you ma'am, and everything goes in one fell swoop...plus the spending money. It's standard practice for these CRA's to disregard the FCRA guidelines, so every person in the country probably has claim potential against them...just need a bunch of people to follow through, and maybe they'll start to do their jobs right for a change...longshot though, since so many(myself included, for the longest time) are petrified at the prospect of court.

No, there was no agreement on my part to never bring suit against them again...they didn't even ask, cause they knew what my answer would have been. Given their track record, I wasn't about to close off any options for me just over the last 1500 dollars worth of tradelines to be deleted.

Besides, those promise of never suing again things would never hold up in court, anyways.

Congrats Xan Thats so cool I think I might being going through the samething very soon. Emailed someone at EQ to give the opportunity to do what is right. They deleted then after the 30days like the 45th day boom its back. Hopefully they learned their lesson. Its a judgement that not mine.
