Collection Agencies calling us

Ok my step son lived with us for about 5 months last year then we kicked him out as he stole from us. Well we have been getting collection agencies calling for him, When they call we call back becasue we donot know if the call is for him or my husband and we tell them that he no longer lives with us and to remove our number , they tell us that they cannot remove our phone number as we are not on his accounts and he needs to call them to tell them that, they then ask if we know where he is we tell them that he is the navy at basic training and we give them a phone number and address for him only to be told that they cannot call him becasue he is inthe military and he is considered a protected class.

We are getting two -four phone calls a day Any idea what we can do?

They are feeding you a line. They are harassing you and your husband. You need not explain anything to them. Ask that they properly identify themselves. If they refuse, tell them you’ll be filing harassment charges against them. Hang up. Keep a log of each time they call back.

If you want, post the numbers here that show up on your caller ID and we’ll see if we can’t track down the names and addresses of these CA’s so the complaint process will go easier.

Telling them not to call will not stop the calls. It has to be done in writing, and to prevent them from stating you cannot communicate with them because your name is not on the account, filing the proper complaints with the proper agencies will get those results.

If they choose to continue the calls after that point, they have made a grievous error.

You can sue them under the FDCPA even if they are not coming after you for payment. The FDCPA governs the behavior of the collector, not wether or not the debt is yours. If they mentioned anything at all about collecting on your son-in-law, or refuse to discontinue calling after telling them he no longer resides there, you can nail them.

Send each CA a cease and desist all communications notice with a notice therein that any/all future telecommunications contact will be recorded. If they call, they consented to being recorded since you notified them in writing that it would be done. Then record the calls and bust-em for a grand each for violating the FDCPA.
