mikkid74
I was told by a CA that the SOL on a medical collection is 7-10 years (this CA is in the state of IL). Can anyone confirm this? Is there in fact a seperate SOL for medical collections vs. other types of collections?
retmar
What State are you in? You need to add this to your information so we can properly assist you. Also, you can go to the top of this page and click on "Statute Of Limitations", then click on your State and it will tell you. A Medical is considered an "Open Account", which in Illinois is 5 yrs. This CA is lying to you, which is illegal. You can also visit your State's websites for their laws to see what they say. You would look in Civil Code, Code of Civil Procedure, and Revised Statutes, to start with.
Recovering Attorney
wow. Tape that guy telling you it's 7-10 years. You can get an account at www.tel-biz.com A medical bill is, as far as I have ever knowm, an open account, fee for services, oral contract type of action, usually governed by the contract SOL. In NYS, the SOL is 6 years. Never heard of one longer.
mikkid74
Thanks for the info. I am in the same state as the CA - IL, so I assume the SOL is the same - 6 years? What "official" SOL info can I arm myself with when contacting the collector again? Does anyone have a form letter I can use?
