Law Firm Claiming to be Assignee for a charged off debt

From what I have read here, an assignee means a company that is collecting on behalf of the OC, correct?

I received a demand for payment in the mail from a collection lawyer for a credit card account. That's the first I've received regarding this debt. Anyway, they claim to be an Assignee of Providian Financial. However, looking at a credit report I received back in March, it shows the Providian account as having been charged off and "Purchased by Another Lendor". It shows my balance as $0 and status as "Charged Off as Bad Debt".

To me, that means that Providian closed this account, sold it to someone else and have no further interest in it.

So, how can this law firm claim to be an Assignee of Providian Financial? Can they? If not, is there any action I can take against them?

Also, the account number the lawyer has on the demand for payment is one number different from the account number on the credit report. I don't know if it's a mistake on their part or they don't even have the correct account number. Will that be helpful at all?

  • 3 years later...

When the CA (as assignee) files a suit, in my reply should I be adding the OC as a third party to the suit? or, should I just let it go at the CA?

Part of what is going on is BOTH the CA and the OC ore adding derogatory history to my CR. Both are falsifying dates etc.

If so, how do I go about adding the OC? I have successfully responded to suits before (and have a 100% settlement rate), but adding a 3rd party is new to me.

You might want to make your question a seperate post.

Actually an assignee can be a debt buyer. They own the debt outright and are just calling themselves " an assignee of Providian Financial " to make themselves more intimidating , in my opinion.
