Guest Posted October 1, 2004 Report Share Posted October 1, 2004 So when a company calls and leaves a computer generated call.. you return the call cause well you arent sure what the heck its about and they start in on you about debt without ever saying they are collecting a debt and the whole kit and kaboodle.. is that a violation??Can't remember.. Guest Posted October 1, 2004 Report Share Posted October 1, 2004 I dont know about mini-miranda but I think they are supposed to say "this is an attempt to collect a debt and any information obtained shall be used for that purpose"She never said that..She said I am calling from X.. about X in the amount of $xxxxx.I thought it was a violation to not disclose they were collecting a debt but who knows. If not, doesn't matter if it was a violation...your word against theirs...And...was it the OC that called, or someone working at the OC's offices? FDCPA doesn't apply.I'm pretty sure if it was a CA and this was your first contact with them, they should have said...this is an attempt to collect a debt...and identified themselves further...butBased on what you've said, you probably wouldn't get very far in court...
