pamelabe
MBNA just froze my bank accounts! Now what? I tried to settle with them through the collection agency and they werent interested in anything less than 75% with a total coming to 17k but the original debt amount was only 10,120k. The other tid bit of info I just noticed on the legal paperwork is they have the wrong account #!! Can I get a lawyer to make their paperwork to the bank that froze the account null and void because of the wrong number long enough to go to the bank to take out my money? chincheck
Was there a default judgement entered against you? Or at the very least, did MBNA file a lawsuit? It doesnt sound like we're getting the whole story because usually there must be a judgement in place before assets get seized.
Recovering Attorney
sounds like it is too late. I would get yourself a lawyer, see what you can get. The marshal adds his fees and the legal interest to the top. Before he does that, have someone talk to MBNA. Worth a shot, anyway
pamelabe
There is and was a judgement inplace. They sued me, I lost because I didnt pay attention to the legal documents. Stupid. I do not own a thing. There are no assets other than the few hundred dollars in my bank account. They seem to want all or nothing and Im somewhere in between but that doesnt interest them. LadynRed
Freezing your bank account is a wake-up call. You've been ignoring them by not making any arrangments to pay the judgment they got, so they went ahead and took what they could and freezing your bank account making it impossible for you to do ANYTHING needing the account. Its a real slap in the face to make you do something to pay them. They can't keep the freeze on indefinitely.Your best bet is to start negotiating. Claim your exemptions so they don't try to come after anything else, but get in touch with them. If you're not in Tx, Pa, NC, or SC, they'll start going after your wages.
