schellmis63
I was wondering why on a summons at the bottom it is stampedThis is from a debt collector? (from the lawyer)
Recovering Attorney
attorneys are covered by teh FDCPA and there is conflicting case law that says legal process is a written communication covered by the Act.
schellmis63
I am still so questioning my case with them. (you know who) i have filed all my paper work and ready for my date to ask for leave. I am still so very confused about whether they think they can really prosecute in this state. Explain for me if you will.If a collection agency hires an attorney do they have to be licensed to collect? I am wondering if there is any way that this CA is using their attorney's to be licensed for them?? What do you think?
Recovering Attorney
You are overthinking this. File a motion claiming they do not have the legal capacity to bring the action in Illinois. Then you will have an answer.
