5greatkids Posted October 9, 2004 Report Share Posted October 9, 2004 I had a credit card acct that was charged off and eventually sold to a zombie collector who got pretty nasty. Then I found this site and DV'd them and never heard back from them!!! They had originally sent me a letter stating the the OC sold the account to them. Today, I rec'd a call from a law office stating that the OC would like me to pay my debt in full. When I mentioned that this had been sold and I was waiting for info regarding that, the new collector/law office said they did not know anything about it being sold. I asked them to put something in writing since I have no clue who they are.....has anyone had this happen before.. do zombie collectors ever sell the account back to the OC??? This 'lawyer' is likely just another collection agency. If the debt is out of SOL - then this gets easier. What state are you in ?Who's the 'lawyer' ?? 5greatkids Posted October 9, 2004 Author Report Share Posted October 9, 2004 This is definitely not SOL- I had been terrorized by the OC and had been making monthly payments that were getting out of hand...."If I pay this amt they would reage the acct....they would lower the payment, lower the interest...put me in a special program...blah blah...then they would never do it!! Eventually DH had a major pay cut and we could not play their game...got charged off last year. The law firm is from GA and they are licensed in my state. The amount the lawyer/CA mentioned is of course about twice what it was originally! The person I spoke with did say they were debt collectors and this was an attempt to collect a debt. Either the zombie guy lied (but how did he get the account) or it was never sold (I have a letter from them that says it was). The new CA said that the OC had placed it with them for arbitration....again, I don't know if this is legit. Since they are licensed-it makes me wonder if they have some ground to stand on. I'd still report the zombie for violating the FDCPA (section 807 False or misleading representations).Doesn't matter if they're licensed or not - it's certainly not an indication of how they behave.
