bf5169698 Posted October 12, 2004 Report Share Posted October 12, 2004 Back in April I dv a ca. I have the copy where they signed for it. I never heard anything until today. I had two phone calls, one seconds after I hung up on the first. The first said she would accept a settlement, the second had no idea the 1st had called, and she said they were going to turn it over for a summons. This stems from a credit card i settled with, I have a letter saying they would accept an amount less than owed as full payment, which I made, and a letter saying they received it etc. The ca is trying to collect on the difference of the credit card. I am amfraid of getting served and having to go to court, what can I do to avoid this, of course I am not going to pay, as I have already paid the credit card what they offered as a sttlement. Does the letter offering / confirming the settlement actually say something like "We will accept $XXX as payment in full against account #XXXXXXXX..."?? I have a copy of the letter saying how much they would settle for and I paid it, have cancelled checks. In the letter it said pay by june 1st. I called the firm and said I would send 70% by the first and the rest by the end of the month,they said that was OK, I did. 14 months later another law firm contacted me for the difference of the original balance and what I settled with them for. Back in april I Dv them, have signed green card from them, but no response from them until they called on tuesday 10-13-04. anti-something Posted October 14, 2004 Report Share Posted October 14, 2004 first up i would try contacting the firm you settled with, and see if thy will send you out a letter stating this account has been settled and no money is owed.whether you can get the letter or not i would write back to the current people telling them this account has already been dealt with and legally settled as payed in full with (fill in name of first firm here), you do not owe any money and if they contact you again, place any info on your CR or proceed with this legal action you will sue them.
