elyse449
Hi folks,I read somewhere that a collection company is not allowed to threaten to sue if they don't fully intend to sue. My question is this; how long do they have? From the time they threaten to sue, how long do they have to actually sue before it becomes a violation...if, in fact, it is a violation?Just wonderin' ... Thanks in advance!Elyse
J_Snow
Dont know but I hate to see an unanswered post. Did you pose the question in the lawyer forum?
JoeDirtPharmD
The FDcPA doesn't outline a 'due date' necessarily, however, they liekly gauge it from a perspective of a reasonable time period. What's reasonable? That's subjective. Could be 60 days, could be 90. Depends.
