C.H.O.D. and Crapitalone question

I am going and currently am default with Crapitalone.

During the C.H.O.D., if I dispute as "not mine" and saying it does not get verified and gets removed totally and then on the next month they report again without notifying me within 5 days, would that constitute as a violation so I can get some barganing power?

Crapitalone is horrible people!!!

Just because it comes off your report, doesnt mean its going to go away. If you owe, you owe...thats all there is to it. Violation or not...the account will still end up being reported one way or another...prolly by a collection agency if not the OC.

My advice is to call CapOne and try to work out some sort of a deal. I know they are a PITA, but honestly, what pther option do you have. :)

What I was saying is, since they report every single month, if the tradeline is removed, and they put another tradeline saying late overlimit, ect, wouldnt that be a violation if they don't notify me within 5 days?

Can't say I know the answer to your question, but I have had very good luck with CapOne. Seems most around here have not though, in all fairness. I would just call and be as honest about everything as you can. If you get lucky you'll get someone nice who will be willing to help you. I was late one time with them and they were really super about it. Neer hurts to try.

As to your question of reporting. Don't expect the TL to be deleted as Crap1 is usually very punctual. If, by chance, it was deleted, then reinserted, your claim would be against the CRA, not Crap1. Therefore, no bargaining power.

As the others mentioned, contact them and see what they have to offer. Ask them to reage the debt so you can remain current, then pay accordingly until satisfied. If they won't offer a program, you offer your own program, but, make sure it is one you can handle. When talking to them, ask for a Supervisor. At all times, ask each and every one you talk to what their name and employee number is. Yes, the lates would remain, but, in the future, you could try the goodwill to get them deleted.

Don't waste your money or time with an Attorney at this point. You can accomplish just as much yourself. If the debt is not charged off yet, they will not accept an offer of settlement. It would have to wait until sold or assigned, but, in the meantime, the amount climbs until paid.
