shamrockgal Posted October 20, 2004 Report Share Posted October 20, 2004 OMG I am so ticked!This phone bill has been nipping at my heels off and on for a few years, has gone to now FOUR collection agencies and the first three have not been able to validate the debt. The last that had it actually had it for a year, and WERE reporting on my transunion report (which I just found out Saturday), but YESTERDAY the phone company removed it from that collection agency to give it to RMA.So, as I am now living 100 miles from where I was a few months ago, the phone calls didn't catch up with me. In fact, I dont know how in the hell they got the telephone number at my mothers - I've NEVER used it on any forms. The girl that spoke to my mother was very rude, and since my parents know like - nothing about my credit, that really pissed me off. I called back and got ahold on some snippy chick - (called because I seriously didn't know if this was work related or what) - and blessed them out - it was actually pretty funny ( i Know i know, DONT SPEAK TO THEM ON THE PHONE!). As she told me that my call may be monitored, I told her that was fine because I also was recoring the phone call - that surprised her and she told me that I didn't have her permission for that - so I let go of that angle (boy it was funny hearing her disturbed). However the rest of the call seemed - really SEEMED like someone else was listening in and coaching her - I told her that I had attempted to get the debt validated with the other three companies, and that they were unable to, that she needed to mail me a letter and that I would reply. She said "We DID mail you a letter" and I asked when - "Yesterday!" I laughed, AS IF I HAD TIME TO READ IT YET - Its not like its ARRIVED yet! Im aggrivated. I'm just really pissed that they called my moms house, was rude to her, and then tried to tell me that they were "Validating the debt over the phone" with me - just aggrivating. Like I said, with work like it is, I thought that perhaps the call was work related - thats the only reason why I returned the call.I cant wait to get the letter from them, I'm going to send them a DV letter and if they mess with me I AM GOING TO SUE.Oh - one more question - previous CA reported it as date opened "XX/03" when really this was a "debt" from a few year ago, like I mentioned. Now, if they change the DOLA -- THAT is illegal reaging and I"d watch RMA -- they are known to re-age.Validating the debt over the phone ??? WTF is that ??? Date opened will figure heavily into your FICO score.. if you have a debt from 95 and it is listed as being opened in 2004.. that is a big deal.I think the open date has to be the date the account was originally opened and then they should list it as PLACED and then the date.Our attorney seemed to agree with me on this one and I am thinking that its a way for them to re-age in a way.Anyone else??? LadynRed Posted December 1, 2004 Report Share Posted December 1, 2004 Date opened figures into your history for FICO but if used by a collection agency is has no effect at all - its still a collection account. Re-aging has nothing to do with the date opened, it has to do with the time a negative trade-line can stay on your reports. If debt is truly re-aged, it means they are trying to 'run the statute' to keep the baddie on your report past the legal 7-1/2 year limit. The ONLY date that matters to 'run the statute' is the date of 1st delinquency that preceeds collection or charge-off as that is the 'date certain' established by the 1997 amendments to the FCRA. LadynRed Posted December 2, 2004 Report Share Posted December 2, 2004 It HAS to fall off, by law, according to the date of delinquency. Changing THAT date IS illegal re-aging. The date opened does not determine the reporting period. CRA's don't show us that 'date certain' but they CAN tell you what it is on the ORIGINAL CREDITOR'S trade-line. You might have to call them to find out what that date is, if its 9/2002 then 2010 would be correct because the period is 7 years PLUS 180 days from that 'date certain'. That would go from 9/2002 to 3/2010. If you have proof of the delinquency date and the CRA's are showing something else, its been illegally re-aged. I'm aggrivated that I even have to mess with all of this.Can anyone give me / point me to a sample letter for a reply?On another note, I had a BOX of checks stolen out of my mailbox a few days ago, had to issue a stop payment on 150 checks after one cleared for $650.
