ceowens
In SC, can creditor with judgement garnish joint checking / savings accts.???? How about a house in both husband and wifes names?? Where might I go to look up these types of things?
LadynRed
If the judgment debtor's name is on an account, you can bet they can and will take what's in it. The only way to protect an account is to NOT have your name on it.The best place for looking this stuff up is in the SC statutes, which includes exemptions from judgments. My hubby has just had a judgement placed against him. I'm thinking he needs to get down to the bank and get his name off of our accts.
