anti-something Posted October 25, 2004 Report Share Posted October 25, 2004 just wandering around online and found a link to experians business database, it tells me that the particular business i have a judgment against are in their files. pp for me?it also states 'business name - private owner' so i'm taking a guess that is the owners CR there. do i have a PP? According to the FCRA:§ 604. Permissible purposes of consumer reports [15 U.S.C. § 1681b](a) In general. Subject to subsection ©, any consumer reporting agency may furnish a consumer report under the following circumstances and no other:(3) To a person which it has reason to believe (A) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer.© The term "consumer" means an individual.Question is whether a judgment can be defined as "an account". Experian grants you the right to use the information provided by Experian for your own use in evaluating actual or contemplated business transactions involving the business entity to which such information relates. You agree to use such information in accordance with all applicable laws and regulations. SUCH INFORMATION MAY NOT BE USED TO DETERMINE AN INDIVIDUAL'S ELIGIBILITY FOR CREDIT OR INSURANCE TO BE USED PRIMARILY FOR PERSONAL, FAMILY, OR HOUSEHOLD PURPOSES OR TO DETERMINE AN INDIVIDUAL'S ELIGIBILITY FOR EMPLOYMENT. and thats about it, what i am concerned about is spending $8 to get a $1000 non-pp bill and what WOULD be the applicable laws? i'm not sure that it IS the FCRA, coz this is not a 'consumer report' on an 'individual' (according to exp, these are business reports on businesses) but i am concerned that the second report it is automatically including in my order IS the guys personal CR. Xanathos Posted October 25, 2004 Report Share Posted October 25, 2004 If you have a judgment against them...and you want to see the credit report to determine their ability to pay a judgment...then you can pull the report just like any CA.
