sheepy Posted October 26, 2004 Report Share Posted October 26, 2004 My mom has 2 credit cards that she can not get paid off. MBNA is at about 29% now and I think she owes around $4000. She called them to see if she could just do a payoff or lower the interest but the guy told her she probably needed to get a part time job! The other credit card is Sears.She is working full time, has just gone through chemo not long ago and her blood counts will not come up and she doesn't have the energy to get a part time job, but anyway, that isn't the point.She thought about filing BK but besides her house, this is her only debt and I'm not sure if it would be worth it. She will never get them paid off because she can only afford the miniumum payments, so what should she do now? She has paid on these for years so the original debt has been paid many times and now she is just paying interest.Any advice would be greatly appreciated. Then and ONLY then, will they even think about putting her on a hardship program. The stupid thing is they won't even consider it until you're already 3-4 months behind. Once it gets right around charge-off, she may be able to negoitate a settlement for less. Other than that, she'll be in debtor's hell with them for the rest of her life at the minimum payment level. Explain the situation as you have here, and ask them to put her on a 12 month hardship program at 5%. Give them a monthly payment # she can afford, if it is not the muinimum. Remind them that she could go BK, or they could sue, but then they would only get 8%. You will get a letter/call from someone in the executive offices. They will tell you they can't lower teh rate below 13%. Bull. Be polite but firm. It may be she has to miss a payment or two beore they do listen, but give this a try. I think she has tried to get another credit card but because she has been late on this one (never missed a payment, just late)....Thanks recovering-attorney. I will send out a letter.
