My wife was pregnant 3 months ago with a Medical Insurance that cover 100%, 3 week ago we got a letter from a Collection company saying that we have a bill for collection for 65 dollars and to call the collection company (talked to a very rude person)and try to explain, he said to call the insurance I also asked for a copy of the bill, the Insurance said they will paid but they never got the bill, 2 days ago I received another call and the same guy said the bill was still not payed and now it is 3 dollars more and I need to be pay, he also mentioned that it is going to a credit company (very rude tried to talk to someone else and he said I won't talk to anyone else,ask for superviser he said he is the supervisor)what should I do I don't want my wife's credit to be effected????I hate collection people this is not fair, I never said I would not pay ,please HELPPPPP Link to comment Share on other sites More sharing options...
anti-something Posted October 28, 2004 Report Share Posted October 28, 2004 contact the hospital/doctor directly. if they havent filed the insurance claim that is not your fault!! also tell them to call off the dogs (CA) coz you are not responsible for this debt they need to bill the insurance.also DV the CA immediately! retmar Posted October 29, 2004 Report Share Posted October 29, 2004 Contact your insurance carrier and ask if they have a "Collections Department". There are several who have someone available to assist in these matters. Also, some carriers have set rules and regulations that must be obeyed by any provider who accepts assignment from one of their beneificiaires. Start there, then move to the OC. Once with the OC, let them know up front that their assignee is very rude and nasty, and that, in some states, an OC can be held liable for the actions of their assignee. Be sure to stress as to the problem lies with them as they never filed the claim "properly". Be sure this can be verified with your insurance first. Do not hesitate to tell them the CA is violating your consumer rights and trying to force you to forfeit your rights under HIPAA and that you will not hesitate to file a HIPAA complaint against them with the proper authorities. Once you have their attention, tell them that once you receive an EOB from your insurance carrier that states exactly what your obligation is, you will remit that amount only to them, not the CA, as you refuse to deal with them in any fashion, and, that there is no law that says you have to. Then, since you obtained the name and title of the person you spoke to, send the OC a CMRR letter clarifying exactly what was said on the phone, including any and all agreements.
