No reply to validation - sent to another ca

Another question.

Had a citifinancial account that was sent to Regional Adjustment Bureau. Received letter from them on 4/22/04. I requested validation and have the return receipt signed and dated 5/19/04 from them. They never replied to my request for validation.

Now on 10/12/04 I received a letter from Imperial Collection Services for the same citifinancial account. Can RAB send this to another company if they never verified it?

Should I send a verification request to Imperial now as well?

This is kinda standard practice. If you DV one CA, the debt may bounce back to the OC and / or get put out to another CA. Even if the OC sells the debt to one CA, who can't validate, that CA may sell it to another.

The theory is that eventually you'll get tired of dealing with it, or it will wind up with a CA who's obnoxious enough, and you'll settle with one of them.

So...yes, DV Imperial. If the first one couldn't validate, they probably can't either. You should be able to keep tap dancing as long as you're willing.

I'm not certain of the answer to that, so you may want to search for other posts. My opinion is that you may be able to get the first one removed from your CRs by sending the CRA a copy of your "dispute" letter along with the green card and a letter stating that the first CA couldn't validate so therefore it must be removed. And I'm pretty sure the second CA can add a TL to your reports until you do the same thing with them. You may eventually have to sue someone in small claims to make them go away.

If a CA is listed on your credit report and it sellls/transfers the debt to another AC, can the first one still report the collection or do they have to remove it and the new CA add it to your report?

If the debt is sold/transfered, the CA must list the tradeline as closed/0 balance, sold/transfered/assigned. It also cannot have any lates attached.

The next CA('s) can list it as it is at the time.

**Update**

Woohoo!! I sent a DV letter to the first CA (one on my credit report) and also disputed the CRA's after I received my green card back. CA did not verify the debt and off the credit reports it went!! I also sent a DV letter to the new CA so I am keeping my fingers crossed on this one!

Thanks for all the help and advice, it really makes a difference!
