ceowens
DH went to see BK atty today....supposedly the best in the county. He worked for a week getting all of his info together...took time from work....drove 30 minutes. When she looked at his debts she told him she could not do his BK because she had a conflict of interest with one of the creditors on the list. Would not say which one. Refered him to another atty. WTF???? Could she maybe be the atty for the local hospital or one of the local doctors on his list????
breathing_easier
Could be for any one of the creditors. She did the right thing by notifying you of her conflict. If she had not, she could be disbarred or, at the very least, sanctioned by her State Bar. Have your husband ask her for a referral to another reputable BK attorney and move on. He has appt. for next Tuesday. It was just sort of a kick in the a$$ to get up the nerve to do it, and then get turned away. Oh well. Now, more waiting....... :sigh:
breathing_easier
Give the new attorney a list of creditors ahead of time just to make certain they don't have a conflict.
ceowens
Give the new attorney a list of creditors ahead of time just to make certain they don't have a conflict.I mean, if you specialize in BK, then why would you also represent creditors????? ceowens
Ugh......After seeing 3 attys, I finally found out that it is the hospital that everyone has a conflict with. The third atty finally sent us to someone who he knew was not affiliated with the hospital, and we got in to see him. Now my only problem is sorting out the mountain of paperwork.
