How should I dispute this BK7 with EQ?

I already disputed a BK7 with EQ as "not mine" and they verified it. I got my EQ report and read it carefuly for the BK. It does not specify the exact day of filing, just the month and year. The BK case number is missing the last three letters even through all the previous numbers are correct. There is no data about the assets and liabilities.

Should I dispute it as:

1) Not mine

2) Never filed BK7 with a filing date of mm/yy

3) Never filed BK7 with a case number of xxxxxx

4) Never filed BK7 with no assets and liabilities listed

I plan on sending EQ my dispute in a few weeks. TIA

The removal of the address involved could help, but, not always.

As to your other notes, the CRA's never include the actual date, only Month and Year. Regarding the Case Number, all CRA's omit the last 4 digits in a report. It is to protect your privacy.

You might try and get the address deleted by phone, then file another dispute and assure it is delivered during CHOD and see if you can get lucky.

I sucessfully got my Bk removed from EQ. I started out with a dispute that said the BK was not mine. EQ came back and said that they did verify the BK as correct. I then waited about three weeks and mailed off a procedural request letter. I then got a letter back in about three weeks that said my BK was deleted from my file. If the CRA cannot provide you with the description used to verify the trade line then they must delete it. Look at section 611 of the FCRA to see what I am talking about. This is what I did and it worked rather well for me. If they do not provide you with that description within 15 days of receipt of your request and don't remove the trade line then they are in violation of the FCRA. Section 611 has become my best friend in my credit repair journey.

In my opinion I think CHOD would be a great time to request a procedural. I would send your procedural request in a letter of it's own and not with any other disputes. You should send your procedural a few days before or after your CHOD letters, at least that is what I would do. Remeber, the CRA has to provide you with a description of the method used to verify the trade line for every reason you dispute a trade line. So keeping this in mind it could take a while and if you still don't get any response from the CRA you might end up in court with them. It all depends on how far you want to take it.

Don't forget to send them all ceritified and star keeping very good records, it will help in the long run.
