creditobsessed
I called my local Magistrate court today to sue about filing suit against a CA for violations. The CA is out of state. They tell me can't sue in my county (state law) that I have to go to where the CA is to sue them. I can't go to FL (I'm in GA) to sue them. I have 5 violations against them. I don't want to threaten them with a suit when I know I can't follow throughWhat can I do?Thanks for all the help!!

Xanathos
Call your local Legal Aid and ask if it's permissable to sue in the court you want to sue in if the "cause of action" (remember that phrase) happened where you are. Most places allow for that.If you can't, then bump it up a level to your Circuit/District court level....more formal, but more open in who you can hammer. Leadhead
What the clerk told you is nonsense. I sued a CA in Fulton County Magistrate that was based in New York. They had a registered agent for Georgia and that's who I sent the summons to.Go to the following website and search fo rthe CA to see if they have a RA. If not, you may have to file in federal court.http://www.sos.state.ga.us/corporations/corpsearch.htm
creditobsessed
Thanks to all for the info. I found out this particular agency does have a registered agent in Norcross. Should I send them DVL before I file? I only sent DV to address in FL I got off the credit report. I got a good feeling that the clerk chick didn't really know what she was talking about. I don't think she's the regular. I'll just go over there and see about filing the paperwork since this is where "the cause of action" occurred. Do I need to have the agent served or the parent co.?Thanks again!
