I am having to file Ch. 7 b/k. I am wondering if I would be outta my mind to file Pro Se. The attorneys all want 750$ and up. Which of course I don't have. I am not totally stupid, and figured I could get do this.

There are no assests involved. I don't even own my car. No house, no nothing. I have searched and searched the web and here, and read alot about it.

What do you all think? Am I off my rocker with this one?

Thanks>>>>

No, people do it all the time. If you truly have no assets, no property transfers in the recent past, no cash advances on credit cards.. then you might ok pro se. Just know that you're going to have to take care of ALL the legal mumbo jumbo and paperwork, serving notices to creditors and the court, all by yourself. YOU cannot even do the actually mailing (service) of the notices, someone else NOT CONNECTED to your case will have to do it.

If you can handle all that, then get the Nolo book, study, and get it done. It'll cost you $209 filing fee, which you can apply to pay in 4 payments, paid in full by your 341 meeting.

***Tips hat at LadyNRed***

My advice is to find an attorney who will accept your monthly payments of 50 bucks or so while you are getting him/her all your info. My lawyer agreed to take all calls. When I got calls, I gave them his # and requested they stop calling me and it worked.

LadyNRed may be OK with pro se, but to my wife and I, it helped us avoid a lot of fear and headaches having a lawyer.

Having said that, I have checked out the NOLO book from the college library and learned a lot from it. That might be a wise first step before you decide to hire an attorney or not.

As she said, "no asset" BK 7's are pretty basic.

Take care and good luck in your decision.

there are quite a few paralegal businesses that will hlp you fill out the paperwork. Probably some online, too. I've been a lawyer fro awhile. I do my own real estate becasue I know it. But I hired someone else for my divorce. And that was a lot more than $750, but it saved me multiple in aggravation. I'd try to hire someone.
