exxo2
I had a collection agency mail me a letter regarding a collection for $100. It was their initial contact and said to respond within 30 days. It even gave a "reply by..." date of Nov 26. However, it jumped on my reports the next day. They can do that ?If not, what would I do here to get it removed FAST ?Thanks.
Xanathos
Depends on which FTC ruling you followhttp://www.ftc.gov/os/statutes/fdcpa/commentary.htmThis says they can. There are FTC letters out there that state adding a tradeline is a voluntary collection activity though....so according to those letters, they would not be able to. direred
There's no easy way to get it removed fast.Sending in a DV letter stating that you dispute the debt will get it marked as disputed, though.Sometimes, it just takes being mean often enough loudly enough. I'm practicing my opera singing just for this purpose. I do have several cases where someone has inserted as a part of continued collection activity and am Taking Appropriate Measures. Recovering Attorney
I would say they could report it, under the circumstances. Becasue you disputed it in writing w/in the 30 days, they cannot assume it is valid and must, at the very least, report it as "disputed." I would write them again telling them to delete pending their investigation. I would also dispute with teh CRA, sayiong it was disputed before it went on and should be deleted.
