ILYN Posted November 17, 2004 Report Share Posted November 17, 2004 I FILED A CHAP 7 ABOUT 2 MONTHS AGO WHICH I KNEW THAT A FEW OF MY DEBTS WOULD NOT BE DISMISSED LIKE STUDENT LOANS AND JOINT CREDIT CARDS, I STILL HAVE PAYDAY LOANS AND NSF CHECKS THAT I NEED TO RESOLVE, ALSO. It looks like you're yelling...And...you filed BK 7 two months ago...were the Payday loans and NSF checks listed on your papers? Has your BK been discharged yet?Hopefully, some others will jump in here, but...in my opinion...the Payday loans are just another creditor. luckyduck Posted November 18, 2004 Report Share Posted November 18, 2004 NSF checks are usually only a crime if you intentionally wrote bad checks. Even if they are a crime, I believe the monetary obligation can be relieved by BK. Criminal and civil are an entirely different realm. You need to list each and every merchant that is charging you nsf fees and list your bank. I've always thought you could be relieved from joint accounts. It will just leave the other party responsible for everything.the only things that cannot be filed on are student loans, child support, alimony (i think), and some taxes. You can even get out of some taxes, I'm just not sure which ones. When you file BK, you need to list each and every person, merchant, financial institution, government agency, everything you can think of, that you owe money to and that you have a contractual obligation to begin owing money to in the future. If you don't file them all, you could actually get in trouble for that.The court will decide who you can and can't file on. You need to list everything.If you only filed 2 months ago, and it hasn't been discharged yet, then you will need to amend it, and go through the process of notifying the creditors you forgot to include. I think you can only amend once, so you better get it right this time.If it has been discharged, then you should probably pay the NSF fees, so that you can show you weren't intentionally breaking the law, but were just trying to get by, and thought that you would have the money to cover it before it got too deep. paying the NSFs will help you if criminal charges are filed. luckyduck Posted November 18, 2004 Report Share Posted November 18, 2004 nope, no debtors prison. Only the one you put yourself in (mental anguish). Instead of worrying about your debt, which will be all over soon, why not focus on living a descent life without credit. You'll be doing that for a while, so focus on making it the best it can be. After a couple of years, you'll either decide you like it better that way, or you'll be ready to start conquering "credit repair" and rebuilding.
