Need answer to UCC complaint question!!!

Due to some very good advice, iIam filing complaint reports to state AG's office and FTC. On the complaint forms it asks " What do you want the company to do?" What answer do i write down? This is a repo case with a CA involved. No notice of intent to sell was ever sent to me and the OC is in violation of the UCC. The CA is attempting to collect on a debt that did not meet the requirements of the UCC, therefore they are in violation of FDCPA. Any suggestions?

I read your message, cntry, but I don't really know the whole story. I'll bump this thread for you though...someone help?

The forms are just asking for what kind of action you want the CA or OC to take. First of all, who are you filing complaints against? Both? What do you want that company to do? Remove the tradeline? Reduce the price? Report correctly? Whatever you want them to do, that's what you state in your complaint.

Make sure you have the ammo and the rights to ask for whatever it is, though....you don't want them to laugh at you and toss your complaint.

Make sure when you send the complaint, you add in an extra sheet of paper (if they don't provide space) to detail everything you possibly can...dates, names, statutes, etc.

I'm not big on UCC law, so can't help too much in that area. But here's to hoping someone else will see this thread for you. *BUMP*

i want the OC to delete the tradeline. They are in direct violation of UCC by not sending notice of intent to sell repo'd vehicle

CA/Lawyer is attempting to collect a debt that did not meet UCC requirements therefore in violation of FDCPA Section 807. FALSE OR MISLEADING REPRESENTATIONS

(2) A The character, amount, LEGAL STATUS Oof any debt;

or get 'em off my a$$. The $ wouldn't hurt

Well, I doubt you're going to be getting any money unless you have a killer case and you take it through the courts.

But, with that first part, you answered your own original question, "what do you want the company to do?" Put in there you want the account removed from your credit file and have it blocked from reappearing.

If you're feeling froggy (and if you have a great case...out of SOL, etc...) that you want no further collection activity taken on this by any party. You just put in there everything you feel you have the right to ask for. Be specific.

Have you read up on WhyChat's repo information? You might want to do that if not.
