Rezin
Real quick synopsis. I owed a measly $71 to Hollywood video, so I figgered I'd just pay it off. It was only showing on 2 or the CRA's...So I pay the CA the full amount, and then it appears on the third, as still in collections. So here is what I intend to send them, just wanted a few opinioons before I zap it off.Credit Protection Associates1355 NOEL RD SUITE 2100 DALLAS, TX 75240 Account Number: XXXXXXXXXXXXOriginal Creditor: HOLLYWOOD VIDEO #XXXXTo whom it may concern:I contacted your company regarding payment on a debt I came across while looking at my credit reports, after being denied credit.. This debt was reported to two credit agencies as a charge off, and was not reported at all to the third. . I paid this debt IN FULL (have credit card receipts) and was assured by both a "manager" and the person whom I gave my information to that this would be removed from my credit profile. It was NOT removed or even updated it is STILL reported as an open account/charge off/collections, and then AFTER it was 100% paid off, it was reported to the third as a charge off/in collections. This is an inacurate report and is in violation of the FCRA (See below) since it was NOT in collections when it was reported.623. Responsibilities of furnishers of information to consumer reporting agencies [15 U.S.C. § 1681s-2] (a) Duty of furnishers of information to provide accurate information. (1) Prohibition. (A) Reporting information with actual knowledge of errors. A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or consciously avoids knowing that the information is inaccurate. If I do not hear back from your company OR see removal of these tradelines within 30 days, my next course of action will be to send a copy of this letter to your state attorney general, and the FTC and begin filing court papers. I have already obtained legal council and notified the credit agencies. I demand DELETION of all tradelines related to this debt on all three CRA's or I will pursue this matter via the court system.I have been informed by counsel that this account was also reported originally in 1998, and is past PA's 6 year statute of limitations.Sincerley,My NameAddressMy SSN
DocDon
Forget the letter. I've dealt with them before. Best bet would be to file a complaint with their State Attorney General's office, outline their violation of the FDCPA (section 807) for the false representation of the character, amount, or legal status of any debt, and the FCRA (section 623) for knowingly providing false information to the CRA's.I went around and around with these idiots for almost three months before I filed a complaint. It was taken care of IMMEDIATELY....
Rezin
Any samples to look over for the AG letters? Any other formalities or methods to report this to the AG?
DocDon
Nothing formal. You simply state you paid this account in full and the item was deliberately reported to another credit repository showing an unpaid status in direct violation of the FDCPA section I mentioned and the FCRA section I mentioned. Cut and paste the sections into your complaint, and demand they immediately remove all entries from your credit files. Here's the key - they committed 2 violations at $1,000 a piece. It would be in their best interest to delete. Given they never respond to letters such as ours, they will be required to answer to the AG's office. You can file the complaint online:https://www.oag.state.tx.us/forms/cpd/cpd_getinfo.php

DocDon
The TX AG decided he doesn't want to handle individual consumer complaints any more. Aparently he found a way to still get paid, and do less work.File a new complaint with your own state AG's Office.
