kildak
I just got off the phone with one of Asset Acceptance's supervisors regarding their collection efforts on a 10 year old unpaid debt of mine that they purchased. Two weeks ago I sent them a certified letter requesting they cease and desist contacting me about this debt and that I would not be paying it as it is outside of Texas' 4 year SOL. However, today I again received a call from AA regarding this debt. I informed the supervisor that I sent AA the certified letter and questioned him as to why they are still contacting me. His repsonse was that he didn't know and that he would talk to the operator who contacted me. Of course, he also asked me if I would like to make arrangements to pay the debt at which time I told him no, I would not be making plans to pay the debt as AA was not the original creditor and the debt was outside of the SOL. He then proceeded to give me the line that the debt is mine and I'm obligated to pay it, so I again told him that I would not be paying their bad debt. His repsonse was that AA is a business and they will get their money from me either voluntarily or involuntarily. I told him that sounded like a veiled threat and asked him numerous times how AA plans on getting the money from me involutarily as I would like to tell the Federal Trade Commission of their plans. His reponse was that is was not a threat and that AA had ways of getting their money from me. Finally he said he had to go as he had other customers who wanted to pay their debts and that was the end of our conversation.Any suggestions on how to handle this veiled threat? LadynRed
TX has some very good consumer protection laws for stuff like this, make sure you also file a complaint with the TX AG too !!
wunderwoman
Do you have any proof that the call came in, like caller ID or will you get an itemized bill? Then you can collect on their violation, since they were not to contact you under the Cease and Desist.Ooh, I wish you could have recorded it.Place a tape recorder next to the phone and if it happens again, put them on speaker phone. I then called AA from my mobile to inquire as to why they were still calling me.Off topic, but your itemized bill comment brought this out of me. I never received an itemized bill from them, just a collection letter a little over 2 months ago stating that I owed them for this account. I did not recognize the account due to the amount (which AA inflated from about $300.00 to $1400.00), the age of the account (charged-off in 1994), and the name of the original creditor (which is no longer in business). I requested twice (by phone) that AA send me verification of the debt, however they never did.
